Terms of Service

Last updated: 5 November 2026

1. Acceptance of Terms

By using Fynqcast ("Service", "Platform"), you agree to be bound by these Terms of Service. If you do not accept these terms, do not use the Service.

We may amend these Terms, for example to reflect changes in the law or in the Service. The updated version is published on this page, with the date of the last update shown at the top, and applies from its publication. Amendments that substantially reduce your rights or increase your obligations will be notified to you by email at least 30 days in advance and will apply from the following renewal; if you do not accept them, you can cancel the subscription before that date. Amendments that merely clarify the Terms or derive from legal obligations apply from their publication.

2. Description of the Service

Fynqcast is an AI-based podcast generation platform that allows you to:

  • Generate podcast scripts using AI
  • Create synthetic audio with stock AI voices
  • Clone your own voice to generate personalized content
  • Manage and publish the podcasts created

3. User Account

3.1 Registration

To use the Service you must create an account by providing accurate and complete information. You are responsible for the security of your account and password.

3.2 Age Requirements

The Service is intended exclusively for users who are at least 18 years old. No exception is provided, including the consent of a parent or guardian. By creating an account you declare that you are at least 18 years old.

3.3 Account Responsibility

You are responsible for all activities that occur under your account. Notify us immediately in case of unauthorized access.

4. Voice Cloning and Biometric Data

4.1 Consent

Voice cloning requires your explicit and separate consent. See our Biometric Data Policy for full details.

4.2 Permitted Use

The voice cloning feature is reserved exclusively for your own voice. You may clone only a sample of your voice, recorded and attested by you during the enrollment procedure (which includes identity verification). The Service is not designed for cloning the voice of third parties, not even with their consent.

4.3 Prohibited Use

It is strictly prohibited to:

  • Attempt to clone or pass off the voice of another person as your own
  • Clone voices of famous people, politicians or public figures
  • Create deepfakes or deceptive content
  • Use cloned voices for fraud, scams or impersonation
  • Generate content that violates the rights of third parties

Depending on the specific circumstances, abusive use of voice cloning to impersonate another person may constitute the offence provided for by Art. 612-quater of the Italian Criminal Code (dissemination of content generated or altered with artificial intelligence systems) or equivalent provisions of other jurisdictions. This does not mean that every violation of these rules automatically constitutes a crime: the classification depends on the specific case and on the assessment of the competent authority.

4.4 Consequences of Violation

In the event of a violation of these rules we may suspend or restrict the account, depending on the seriousness of the violation and in the manner described in section 9. In the most serious cases we may also consider reporting to the competent authorities and initiating legal action, without prejudice in any case to your mandatory consumer rights.

5. Content

5.1 Your Content

You retain ownership of the content you create. You grant us a limited license to host, process and display your content in order to provide the Service.

You declare that you own, or have obtained, all rights, licenses, authorizations and consents necessary for the materials you upload, provide or use through Fynqcast, including, where applicable, texts, books, articles, images, music, audio recordings and other third-party materials. Such rights must be sufficient to allow us to upload and process them, transform them through artificial intelligence, create the output you request and, when you choose to do so, publish or distribute such output.

You may not use the Service for materials or uses that infringe copyright and related rights, trademarks, privacy rights, the right to the image, voice or person of third parties, other third-party rights, or that are defamatory or otherwise unlawful.

You are responsible for the materials you provide and the uses you request from the Service, to the extent permitted by applicable law; the responsibilities of Fynqcast that cannot be excluded or limited by law remain in any case unaffected. We may limit, remove or disable content or features of the Service in the presence of a sufficiently substantiated report, an order from the competent authority or other legal obligation.

Anyone, even without an account, can report to us content they consider unlawful through the form Report content (notice and action mechanism under Art. 16 of Regulation (EU) 2022/2065). If you have provided an email address, we confirm receipt and communicate the decision to you, with information on the available means of redress.

5.2 Prohibited Content

You may not create or distribute content that:

  • Violates applicable laws or regulations
  • Is defamatory, slanderous or fraudulent
  • Contains hate, violence or discrimination
  • Violates intellectual property rights
  • Contains malware or harmful code
  • Is sexually explicit or obscene
  • Promotes illegal activities

5.3 AI-Generated Content

Content generated through our Service is produced with artificial intelligence. We already apply certain transparency measures (technical metadata) to part of the audio content generated (podcasts); we are completing the uniform technical implementation of marking/provenance on all final audio files, including audiobooks, in accordance with the applicable transparency obligations of the EU AI Act (Art. 50). We do not claim full technical compliance of the Service with the EU AI Act: it is legislation undergoing progressive application, and we are working to align our technical measures with its requirements.

6. Subscriptions and Payments

6.1 Plans

We offer various free and paid plans. Applicable plans, features, limits and prices are shown on the Pricing page before purchase.

6.2 Billing

Subscriptions are billed in advance on a monthly or annual basis. Payments are processed by Stripe.

6.3 Refunds

You can cancel your subscription at any time: cancellation prevents subsequent renewals and access remains active until the end of the billing period already paid. Ordinary cancellation does not coincide with the exercise of the right of withdrawal. If you are a consumer, you are entitled to the mandatory rights provided by law, including the right of withdrawal where applicable and refunds due by law; these Terms do not limit them.

If you are a consumer, you can exercise online the right of withdrawal from the subscription contract using the function Exercise the right of withdrawal: you immediately receive a confirmation on screen and by email with a reference of the request, which we verify and to which we respond with the outcome.

The right of withdrawal belongs to the consumer within 14 days of the conclusion of the contract. After that period the withdrawal can no longer be exercised and no refund is due; you can always cancel the subscription, with effect from the period following the one already paid. Since at purchase you expressly ask for the service to start immediately, if you withdraw within that period you must pay an amount proportionate to the service provided up to the moment you notified us of the withdrawal, calculated on the price paid (Art. 57(3) of the Italian Consumer Code); we refund only the difference, using the same means of payment, within 14 days of receiving the notice. For this calculation, each minute generated is valued at the price paid divided by the minutes included in the paid period (the plan's monthly minutes, multiplied by 12 for an annual payment), also taking into account the days elapsed in the paid period; if the minutes used reach those included in the paid period, the amount due equals the price paid and no refund is due. The amount is determined case by case, based on actual use and the days actually elapsed.

6.4 Price Changes

We reserve the right to change prices with 30 days' notice.

7. Intellectual Property

7.1 Our Property

The Service, including software, design, trademarks and documentation, is our property or licensed to us. You acquire no rights to these elements.

7.2 Your Property

Fynqcast does not claim ownership of the original materials you upload or provide. Any rights in content generated through the Service, including podcasts and voice profiles, belong to you to the extent recognized by applicable law — the copyright regime for works generated with the aid of artificial intelligence is still uncertain in several jurisdictions, and we therefore do not guarantee an automatic exclusive copyright over every output. Any third-party rights in the source materials or materials incorporated into the outputs remain in any case unaffected. You are responsible for ensuring that you have the necessary rights, as described in section 5.1.

8. Limitations of Liability

8.1 Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied.

8.2 Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for indirect, incidental, special, consequential or punitive damages arising from use of the Service. This limitation does not exclude or limit our liability in cases where the law does not allow it (for example willful misconduct, gross negligence, or personal injury) and does not prejudice the rights that, as a consumer, you cannot contractually waive.

8.3 Indemnification

To the extent permitted by law, you agree to indemnify us against third-party claims arising from your negligent or willful breach of these terms or from your improper use of the Service. This commitment does not apply to claims arising from our gross negligence, willful misconduct, or violation of law on our part, and does not limit the mandatory rights you have as a consumer.

8.4 Service Availability, Outages and Refunds

FYNQCAST relies on its own and third-party infrastructure and services, which may be subject to interruptions, delays or malfunctions. To the extent permitted by law, FYNQCAST is not liable for indirect damages arising from events beyond its reasonable control.

In the event of a verified outage, FYNQCAST undertakes to assess the report and, where possible, to respond within 7 days. Users of paid plans may be granted refunds or proportional price reductions, in accordance with the applicable conditions and the rights provided by law.

The mandatory rights of users and any liability that cannot legally be excluded remain unaffected.

9. Termination

9.1 By You

The user can start the account closure procedure from the profile settings. Any data or assets that require a prior deletion procedure are handled in accordance with the Privacy Policy and the applicable flows.

9.2 By Us

We may suspend or terminate your account in the event of violation of these terms, fraudulent activity, or for other legitimate reasons (e.g. discontinuation of the Service), with reasonable notice when circumstances allow. In the event of serious or urgent violations we may act without notice. This clause does not prejudice the mandatory rights you have as a consumer, including the right of withdrawal and of refund for the portion of the service not enjoyed where provided for by law.

9.3 Effects of Termination

Upon termination, your data will be deleted in accordance with our Privacy Policy. Biometric data is handled in accordance with the Biometric Data Policy.

10. Governing Law

These Terms are governed by Italian law. For consumers, the forum mandatorily provided for by applicable law remains competent; in other cases jurisdiction is determined in accordance with applicable law.

11. US Users

If you are a resident of the United States, the following additional conditions apply:

11.1 California (CCPA)

California residents have specific rights regarding their personal data. See our Privacy Policy for details.

11.2 Illinois (BIPA)

Illinois residents are subject to the Biometric Information Privacy Act. Voice cloning requires a separate written release compliant with BIPA. See our Biometric Data Policy for full details.

12. General Provisions

12.1 Entire Agreement

These terms, together with the Privacy Policy and the Biometric Data Policy, constitute the entire agreement between you and Fynqcast.

12.2 Severability

If a provision is held to be invalid, the others remain in force.

12.3 Waiver

Failure to enforce a right does not constitute a waiver of that right.

13. Amicable Dispute Resolution

FYNQCAST places great importance on the trust and satisfaction of its customers. In the event of problems, complaints or disputes, we invite you to contact us at legal@fynqcast.com so that, together and in good faith, we can look for a quick, fair and amicable solution.

This route is optional and does not limit, suspend or exclude any right or remedy provided by law, including the right to turn to the competent authorities or to the courts.
